FAQs
Who is eligible to use red diesel (gas oil) for agricultural purposes?
Who is eligible to use red diesel (gas oil) for agricultural purposes?
Since April 2022, HMRC updated the rules on who can use rebated (red) diesel. Farmers and growers can continue to use red diesel for agricultural and horticultural vehicles, machinery and equipment used in the course of their business - including tractors, combine harvesters, crop dryers and irrigation pumps. Some uses that were previously permitted (such as in construction equipment on farm or for vehicle washing) are no longer eligible. BATA can help you understand your obligations - call our fuel team for up-to-date guidance specific to your operation.
What are the regulations for on-farm fuel storage?
What are the regulations for on-farm fuel storage?
On-farm oil storage is governed by the Control of Pollution (Oil Storage) Regulations (England) 2001 (and equivalent regulations in Wales and Scotland). If you store more than 200 litres of oil on a farm, the storage facility must meet specific standards including secondary containment (bunding) to hold 110% of the tank's capacity, protection from weather damage and accidental impact, and pipework that is within the bunded area or protected from leaks. BATA can supply, install and certify compliant storage tanks and bunds - contact us for a free site assessment and no-obligation quotation.
What happens if red diesel is found in a road vehicle during a DVSA check?
What happens if red diesel is found in a road vehicle during a DVSA check?
Using rebated red diesel in a road vehicle is a serious offence that attracts significant financial penalties and potential vehicle seizure. HMRC and DVSA conduct roadside testing using dip-stick tests that detect the red dye marker. If found, penalties can include fines up to £250 per offence plus the repayment of evaded fuel duty, plus potential prosecution. Always ensure road-going farm vehicles are filled with road diesel (ULSD) and never mix or top up with gas oil by mistake.
How do I plan my annual fuel requirements to avoid shortages?
How do I plan my annual fuel requirements to avoid shortages?
The key is to plan ahead based on your farming calendar. Typical high-demand periods include spring drilling (April-May), harvest (July-September) and winter livestock feeding and building heating (November-February). We recommend maintaining a strategic stock level going into each peak period - typically at least 30–40% of your tank capacity. For grain dryers especially, running out of fuel during harvest is costly: build in a safety buffer and consider our automatic top-up service to eliminate the risk entirely.
